ITC, The U.S. International Trade Commission, has rejected 8 out of 10 patent claims made by Apple. Apple originally files a complaint that HTC infringes upon 10 of its patents. The judge ruled that HTC infringed only on 2 patents.
It is a dead end for Android? No. According to reports only one of the two patents in question might be related to Android.
Some newspapers are reporting the doom of Android, all referring to a blog written by Florian Mueller. Mueller wrote as if the case is the end of Android without mentioning that it was Apple which lost 8 patents, which means the company won't be able to use those patents against any other mobile player.
HTC avers “The ITC’s Staff Attorney independently studied the facts and argued at trial that HTC does not violate any of the 10 Apple patents.”
HTC is in a very strong position fight Apple. It must be noted that ITC earlier gave a ruling that Apple infringes on the patents of HTC's subsidiary S3 Graphics as part of ITC Investigation No. 337-TA-724.
HTC has been fighting Apple vigorously and with ITC's ruling in its favor, HTC is in a very strong position to force Apple to bring on negation table.
Apple has been found guilty by ITC, before
This is not the first time Apple has been found infringing upon patents of other companies. Recently Apple agreed to pay Nokia as it was found to infringe on Nokia's patents.
Apple also lost its case against Kodak when ITC rejected Apple claims and favored Kodak. The six-member ITC commission will review the ruling and make its own determination on the case in September.
HTC has couple of options, based on its ITC ruling that Apple infringes on its patents it can sign a deal with Apple and both companies will drop the charges
